Effective October 16, 2008, the increased Suffolk County recording fees are as follows:
- Per page fee will increase from $3 per page to $5 per page.
- Handling fee will increase from $5 per document to $20 per document
All documents presented or re-presented for recording on or after October 16, 2008 will be assessed at the new fee.

As of Monday, June 2nd, customers can E-File the most common Uniform Commercial Code statements.
E-Filing offers customers many benefits. UCCs can be E-Filed at any hour of the day, even when the Office of the Westchester County Clerk is closed. And customers can E-File from any location with an internet connection. Fees can be paid online with a credit card. Customers receive e-mail notice of filing. The system is easy to learn and simple to use. There is no fee for the use of the system, though the statutory processing fees must still be paid.
The Westchester County Clerk’s UCC E-Filing system permits the filing of initial Uniform Commercial Code, or UCC-1 statements, as well as UCC-3 Amendments, electronically. To access the Westchester County Clerk’s UCC E-Filing System, go to ucc.westchesterclerk.com.

We have just been informed of the following change regarding Power of Attorney in the Westchester county clerk’s office. We have also been informed that the new Power of Attorney requirements will be effective for all documents executed after Monday, April 7th. They will accept documents without a Power of Attorney being submitted with the document (for individuals) if executed prior to April 7th if the document contains a note indicating “executed prior to 4/7/08—Power of Attorney not required to be submitted.” This policy is effective immediately:
All conveyance documents that reference a Power of Attorney, or are signed and executed by a signature under Power of Attorney, whether individually or by attorney-in-fact for a corporate entity, must comply with the following in order for a conveyance to be accepted for recording:
- For both individual and corporate executed documents, a Power of Attorney must be of prior record, or submitted simultaneously therein, with the conveyance tendered for recording;
- For a conveyance submitted for recording with reference to a prior filing of a Power of Attorney, the conveyance must contain reference to the liber and page, control number and file date of the Power of Attorney;
- For conveyances submitted for recording with reference to a prior filing of a Power of Attorney not filed in the Land Records Division, the conveyance must be accompanied by a certified copy of the prior recorded Power of Attorney.

Currently, when an instrument effecting the conveyance of real property will be recorded more than 15 days from the date of transfer, Form TP-584, Combined Real Estate Transfer Tax Return, Credit Line Mortgage Certificate and Certification of Exemption from the Payment of Estimated Personal Income Tax, is required to be filed directly with the Tax Department. Upon request, the Tax Department issues a receipt to the person filing the return. The receipt is a copy of the filed TP-584, stamped “RETT Department of Taxation and Finance” and indicating the date and amount of tax paid.

A new law (Section 106-49 of the Mamaroneck Town Code), effective January 1, 2006, has been enacted to combat the illegal connections to the public sanitary sewer lines since such connections are having an adverse effect upon the environment, especially the Long Island Sound.
This law will impact the sale of real estate in the unincorporated portion of the Town of Mamaroneck as it makes it illegal to occupy any building on real property SOLD after January 1, 2006, without there being a Discharge Compliance Certificate for the property (Please note, this law does not apply when the property is being mortgaged, leased, transferred as a gift, or where title passes upon death).

Advances in technology over the past few years have made the preservation and accessibility of records even more improved.
